Terms of Use

1. Purpose

These Terms of Use (hereinafter "the Terms") define the terms and conditions of use of the Sekalis platform (hereinafter "the Platform"), accessible at sekalis.be, as well as the rights and obligations of the parties in this context.

The Platform is published by Sekalis, a company registered in Belgium.

Use of the Platform implies full and complete acceptance of these Terms. If you do not accept these conditions, you must not use the Platform.

2. Access to the service

The Platform is accessible 24 hours a day, 7 days a week, subject to interruptions necessary for maintenance, updates or in the event of force majeure.

Sekalis reserves the right to temporarily suspend or interrupt access to all or part of the Platform for maintenance or improvement purposes, without this giving rise to any compensation.

Access to the Platform requires an Internet connection and a modern web browser. Internet access costs are borne exclusively by the user.

3. Registration and user account

To use the Platform's services, the user must create an account by providing accurate, complete and up-to-date information. The user agrees to update their information in the event of any change.

Each account is personal and strictly confidential. The user is responsible for the confidentiality of their login credentials and all activity carried out from their account. In the event of unauthorised use, the user must immediately notify Sekalis at contact@sekalis.be.

The email address used during registration must be verified. Access to services is conditional upon this verification.

4. Subscriptions and payment

4.1 Subscription plans

Sekalis offers several subscription plans (Starter, Business, Enterprise), the features, pricing and included services of which are detailed on the Pricing page.

4.2 Payment

Payments are processed securely by our payment provider Stripe. Sekalis does not store any credit card information on its servers.

The subscription is billed monthly or annually depending on the plan chosen. Payment is due on the subscription date and automatically renewed at each billing period.

4.3 Right of withdrawal

In accordance with Article VI.53, 1 of the Belgian Code of Economic Law, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent. By accepting these Terms and using the services, the user acknowledges waiving their right of withdrawal from the moment the service begins.

4.4 Price changes

Sekalis reserves the right to modify its pricing. Any changes will be communicated to the user at least 30 days before taking effect. Users who do not accept the new pricing may cancel their subscription before the next billing date.

5. User obligations

The user agrees to:

• Use the Platform in accordance with its intended purpose and applicable laws
• Not publish any unlawful, defamatory, discriminatory, pornographic content or content that infringes the rights of third parties
• Not attempt to circumvent the Platform's security measures
• Not use the Platform for spam, phishing or any fraudulent activity
• Not reproduce, copy or resell all or part of the Platform
• Not intentionally overload the Platform's infrastructure
• Respect the intellectual property rights of Sekalis and third parties

The user is solely responsible for the content they publish through websites generated by the Platform. Sekalis reserves the right to remove any content that violates these Terms or applicable law, without prior notice or compensation.

6. Intellectual property

6.1 Sekalis property

The Platform, its architecture, source code, interfaces, brand, logo and all its constituent elements are the exclusive property of Sekalis and are protected by intellectual property law.

6.2 User content

Content created by the user through the Platform (website text, uploaded images, configurations) remains the property of the user. Sekalis does not claim any ownership rights over such content.

The user grants Sekalis a non-exclusive, limited licence to host and display their content, as necessary for the provision of the service.

6.3 AI-generated content

Text and visuals generated by artificial intelligence as part of website creation are made available to the user for use within the scope of the service. The user is responsible for verifying the accuracy and compliance of such content before publication.

7. Liability

7.1 Sekalis liability

Sekalis undertakes to provide its services with due diligence and in accordance with professional standards. This constitutes an obligation of means, not of result.

Sekalis shall not be held liable for:

• Temporary service interruptions for maintenance or updates
• Malfunctions related to the network infrastructure or the user's internet service provider
• Content published by users through generated websites
• Inaccuracies in content generated by artificial intelligence
• Indirect damages (loss of revenue, data loss, etc.)
• The availability or quality of third-party services (Stripe, OVH, Pexels, Anthropic)

7.2 User liability

The user is solely responsible for their use of the Platform and the content they publish on it. The user indemnifies Sekalis against any third-party claims resulting from their use of the Platform.

8. Termination

8.1 Termination by the user

The user may cancel their subscription at any time through their Stripe management portal. Cancellation takes effect at the end of the current subscription period. No pro-rata refund will be provided for the remaining period.

8.2 Termination by Sekalis

Sekalis reserves the right to suspend or terminate a user's account in the event of:

• Violation of these Terms
• Fraudulent or abusive use of the Platform
• Publication of unlawful content
• Non-payment of the subscription after a reminder

8.3 Consequences of termination

Upon termination, the services associated with the account (website, email) will be deactivated. User data will be retained for 30 days and then permanently deleted, unless a legal obligation requires retention.

9. Personal data

The processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

10. Applicable law and jurisdiction

These Terms are governed by Belgian law.

In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavour to reach an amicable solution. Failing this, the dispute shall be submitted to the competent courts of [To be completed - judicial district of the registered office], Belgium.

In accordance with European Regulation No 524/2013, the user may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

11. Changes to the Terms

Sekalis reserves the right to modify these Terms at any time. Changes shall take effect upon publication on the Platform.

In the event of a substantial change, users will be notified by email at least 15 days before the new conditions take effect. Users who do not accept the changes may cancel their subscription before they take effect.

Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms.
